Section 3310.522. Maintaining eligibility

  • In order to maintain eligibility for a scholarship under the program, a student shall take each assessment prescribed by sections 3301.0710 and 3301.0712 of the Revised Code, unless the student is excused from taking that assessment under federal law or the student's individualized education program or the student is enrolled in a chartered nonpublic school that meets the conditions specified in divisions (K)(1)(b)(ii) and (K)(1)(c) of section 3301.0711 of the Revised Code.

    Each registered private provider that is not subject to division (K)(1)(a) of section 3301.0711 of the Revised Code and enrolls a student who is awarded a scholarship under this section shall administer each assessment prescribed by sections 3301.0710 and 3301.0712 of the Revised Code to that student, unless the student is excused from taking that assessment or the student is enrolled in a chartered nonpublic school that meets the conditions specified in divisions (K)(1)(b)(ii) and (K)(1)(c) of section 3301.0711 of the Revised Code, and shall report to the department the results of each assessment so administered.

    Nothing in this section requires any chartered nonpublic school that is a registered private provider to administer any achievement assessment, except for an Ohio graduation test prescribed by division (B)(1) of section 3301.0710 or the college and work ready assessment system prescribed by division (B) of section 3301.0712 of the Revised Code to any student enrolled in the school who is not a scholarship student.
