Section 1523.17. Condition precedent to construction of dam and reservoir project

  • In all cases in which a public authority, private organization, or person petitions for the construction of a dam and reservoir project as authorized by sections 1523.14 to 1523.20 of the Revised Code, the chief of the division of water resources, as a condition precedent to the construction of such project, shall require the petitioning authority, organization, or person to pay the petitioning authority's, organization's, or person's share of the cost and expense of such project.

    Any deficiency shall be made up by the parties bearing the cost before any further work is done. If the deficiency is not made up within sixty days after it is known, the amount paid in, less the expense incurred by the chief and the cooperating public authorities, shall be refunded to the donor. After completion of the work, any amount remaining to the credit of the project shall likewise be refunded.
